Mary Walker, Facts, Speculations, and Conclusions

It all started in the fall of 2004 when I ran across a forum post that said Mary, Francis, and Patience Walker were not children of Francis Walker and Elizabeth Soule. This went against everything I had seenin the last few years on Mary Walker, one of my ancestors.

An article by Robert C. Anderson in the Mayflower Quarterly was citedas the source for the above. I got a copy, and after reading it, I could not believe that so much faith had been put into what to me seemedinnuendo piled on top of assumptions. To me, it looked like he had taken a few facts, made several assumptions and stated those assumptionsas irrefutable proof of his conclusions. When I started to investigate further and started to question Mr. Anderson’s work, I was called a“crackpot”. I was told his paper was built on pillars of fact, and etc. This only strengthened my resolve to try and solve the puzzle thatI was told was impossible to solve. What I found strange was that authors such as Susan Roser, whose books on the Mayflower were all but thrown out, were standing behind his work arm-in-arm. I found nothing questioning the work by Anderson on Francis Walker.

In what follows, I have made an attempt to set the record straight and to put people back with their rightful parents. It may be looked upon as trash, but I believe that I have done my homework, tried not to make too many assumptions, and conclusions that were made are based onthe facts as we know them today.

1. Ca. 1638-1644 Francis Walker of Massachusetts is probably born. There is no proof of birth, parents, or etc., but other facts lean toward this being the range of his birth.

2. Ca. 1667/68 Elizabeth Soule probably had born a child. There is noproof of this birth, but the speculation is based on the Plymouth Court Record where she was tried in 1667 for fornication with an unnamed male.

3. By July 1668 Francis Walker and Elizabeth Soule are married based on George Soule giving land to Francis Walker and John Haskel, his sons-in-law. Speculative is that George Soule gave land to Francis Walker as payment for marrying his daughter. This would also seem to reinforce the fact that Elizabeth had been expecting a child.

4. After 1668 nothing more is known of Elizabeth Soule. She just vanishes from the records.

5. 1677. George Soule’s will states that he has given land to his daughters, Patience and Elizabeth, through their husbands. Copy of will exists.

6. 1677. Codicil to George Soule’s will states that John (Soule) is not to bother Patience, or will forfeit his rights to other lands. Elizabeth is not mentioned and Francis Walker owns the other half of theparcel in question. Codicil to will. Speculative is that John may feel he has an interest in the land Patience has been given by their father—possibly a first son inheritance sort of thing, maybe.

7. There is no record of Francis Walker’s death in Massachusetts--court or otherwise.

8. There is no court appointed trustee for Francis Walker’s estate. This most certainly would have occurred if he left no will, and no record of a will exists in Massachusetts (or elsewhere for that matter).

9. 1697 John Haskel represents Francis Walker in a Massachusetts landtransaction. Why? Where was Francis Walker that he could not be present to act in his own behalf? Land records exist.

10. In a land transaction by John Hascall

“…honoured father John Hascall dec’d & Francis Walker” would clearly seem to indicate that Francis Walker is alive in 1709, and that is seven years later than the death date given by Mr. Anderson.

From the above it can safely be said that Francis Walker and Elizabeth Soule were married, probably had at least one child but Francis wasnot the father, and that Francis was probably alive as late as 1709. The question remains, Where were Francis and Elizabeth after 1668? Through the years Francis Walker had some land dealings in Massachusetts up to 1697, when John Hascall represents him. Why did he not representhimself? This is a question that must be asked, but may never be answered. As we shall see he does not represent himself anytime after thatdate, either.

What of the Francis Walker of Woodbridge, New Jersey and how does he fit into the scheme of things? It looks like he first appears in 1667 in Pennsylvania, about the same time Francis Walker first appears in Massachusetts, thus two Francis Walkers seem to exist.

This is the Francis Walker that it is assumed to have arrived in Staten Island ca 1680 and used a small letter o (or small circle) as his mark. Compare this to the Francis of Middleboro who used an X mark. So it must be taken as fact that there was two Francis Walkers, one in Staten Island, New York and one in Middleboro, Massachusetts at the sametime and about the same age. So, who are the parents of whom?

Starting with Isaac, here is what we know about him:

A. He first surfaces in Piscataway NJ in the town records of 1692when he gets married.

B. He makes his first land purchase July 1693 almost a year afterhe gets married.

C. 1701 Isaac sells his lands in Woodbridge NJ and returns to Massachusetts to begin selling some of his father’s lands. This proves the fact that Francis Walker and Elizabeth Soule are his parents.

D. Based on his marriage date and his land purchase date it is quite possible that Isaac had to wait until he was 21 to make the purchase indicating a birth date ca 1672. This means he cannot be the child of the 1668 court proceedings.

E. One of his land parcels he is selling is described as being “bound by land that belongs to his honorable father”. This would also seem to indicate that Francis was alive at this time. Francis Walker is also referred to as “formerly of Middleboro” which would seem to indicate he has moved from there, and not (as Mr. Anderson states in hiswork) that it means Francis is deceased. See number 10 above where John Hascall is clearly stated to be deceased at the time, but the same is not provided for Francis Walker.

From the above it can be concluded that Isaac, the son of Francis Walker, is selling land that belonged to his father. This in no way meansthat Francis has died. There are no court records to indicate a death, no records of a will, or of a trustee being appointed to handle hisestate. The argument that it was just poor record keeping is not strong enough to warrant the conclusion Francis has died. Sometime prior to 1692 Isaac arrived in Piscataway, New Jersey. Why, or how, are a mystery, but the fact remains he is there. And, if not for the fact thathe returned to Massachusetts, Isaac would have never been connected to Francis and Elizabeth.

Mary Walker first shows up in the Woodbridge town record when she marries John Ayers in 1688. If she was 20 years old when she married thatwould place her birth at about 1668 which is when Francis and Elizabeth get married and she may be the child of Elizabeth and some unnamed male—referring to the court case involving her fornication charge.

Patience Walker first shows up in the Jeffery Manning will of 1692 where she is listed as a servant and is to be given property upon her marriage. She gets married in 1698 and her birth has been placed at about 1678 to 1680 making her about 12 to 14 when she is mentioned in theManning will. A person that age would be expected to have parents andfamily in the area, but who are they?

The town record for Woodbridge show Francis Walker and Ann having children from 1684 through 1696, a period of twelve years. To add another16 years (earlier) to that to accommodate the birth of Mary Walker would be pretty far fetched. Ann would have been having children over 28years, and if that were the case, there were a lot of years in between the early births and the later ones. The early records for Staten Island mention Francis Walker having a son, but no other children are mentioned.

Francis Walker of Woodbridge is mentioned several times in the Woodbridge town record and some of his land transactions involve land going to his children. No record associates him with Mary or Patience.

Problems with the MFQ V50-1 article by Robert C. Anderson:

Pg33. He states that Francis Walker must have died in 1701 and “he was certainly not alive in 1702.”

Pg 33-4. April 9,1702 Isaac sells some of his father’s land “which was my father’s lot, bounded by lot of my honored father Francis Walkerand John Hascall.” This would seem to indicate clearly that at this time Francis Walker is alive.

Pg 34. Francis Walker is described as formerly of Middleboro. Usuallythis means a person has relocated from wherever he was formerly from.Anderson does agree that it usually means that someone has moved away, but in this instance he has decided that it can only mean that Francis Walker is deceased by this time, 1705, as no other residence has been found for him. The problem with all this is that a deceased personwas usually stated as deceased. Witness the land transaction (ref 10 pg 2 of this paper) where John Hascall sold a piece of land that had belonged to his Father who was stated as “deceased” and Francis Walkerwho clearly must have still been alive in 1709, the date of the transaction. The mere fact that no record of a residence is existing (in Massachusetts) does not mean that he was not living elsewhere.

The same can be said of Isaac. He did he not exist before he showed up in Piscataway town records as having married. Where was he before then, and who did he live with? If Mr. Anderson’s article is taken at face value, he spent most of his early years in limbo, no parents or family, not even a home to live and sleep in. Then, after he did show upand married, where did he and his wife, Desire, live? He waited a year into his marriage to purchase land upon which to live. It was quitecommon for a son to stay in his father’s house until acquiring a place of his own.

Pg 36. Mr. Anderson states that since Isaac acted alone in the selling of his father’s lands that he had to be an only child. This was based on the notion that Francis was deceased, but as has been shown there is no proof of that, and it could be considered what proof does exist is to the contrary. He cites the lack of records as merely poor record keeping. The fact that Francis is alive should be proof that the records of probate, and etc., would not have existed at this time. Also, if Francis is alive then there would have been no need to involve the other children in the transactions.

Pg 37. Mr. Anderson states that the median male age to marry was about 25, but fails to mention that a look at the records would show that marriage age of 20/21 was quite common. This would have put Isaac’s birth ca 1672 and clearly would not have fit his assumptions.

Pg 37. If we are to conclude that Patience was married at age 18, then she would have been about 12 years old at the time of the Jeffery Manning will of 1692. This would seem to indicate clearly that her parents must be in the same area and as we have already seen Isaac Walker is in the same area as Patience, and at the same time. It is most probable that Patience was from the same household as Isaac Walker making them brother and sister. There is nothing in the records to indicate that she has any connection to either Francis Walker of Woodbridge, or to Samuel Walker of Piscataway, but if as suspected she is a sister ofIsaac’s, then she should be a daughter of Francis Walker and Elizabeth Soule.

In looking at Mary Walker and her marriage of 1688 to John Ayers, it is easy to conclude that she was probably born ca 1667/8 thus placing her at the right age to be the child born to Elizabeth and the unnamedmale cited in the court records. Since Isaac is probably too young, and Patience is definitely too young, that leaves Mary as the only possibility to be the child born out of the fornication charges brought against Elizabeth Soule. Remember, the last record for Francis acting inhis own behalf in Middleboro is ca 1686 when he sold some land. That gives him 2 years to have removed to NJ allowing ample time for Mary to meet and marry John Ayers. Had Isaac been about 25 at the time of his marriage, he should have had a place to move to upon his marriage. But, he waited a year, possibly indicating he was not old enough to make a land purchase. The law required that a landowner be 21 years of age.

Francis Walker of Woodbridge was active in selling his lands to his children. Mary and Patience are not among them. They are not mentioned in any record in conjunction with him. Therefore, it can be safely said that he had no connection to Mary, Patience, and Isaac Walker basedon the records that exist.

In looking at the facts, it seems that Francis Walker of Middleboro may have been a strange person indeed. If he had been “bought off to marry Elizabeth,” he may not have felt much of a bond for that child, which should have been Mary, and therefore not had much feeling for her.Isaac, as his legitimate son, would have had a much stronger bond as he was his first-born son, etc. Elizabeth just seems to vanish after 1668 and we know nothing about what happened to her. In looking at George Soule’s will of 1679 she must have still been alive at that time. It is quite possible (perhaps even probable) that Elizabeth died in childbirth with Patience. If this is the case, then Francis may not havehad much feeling towards her, either, as she would have been the cause of Elizabeth’s death in his mind. This would be consistent with a ca 1680 birth for Patience and no other children born to Elizabeth.

The only logical conclusion that can be made is that Mary, Isaac, andPatience are the children of Elizabeth Soule first of Massachusetts and last of New Jersey. To conclude otherwise is to blindly ignore thefacts. It is not difficult to put Mary and Patience with Elizabeth once we know that Isaac is her son and in the Piscataway area along withMary and Patience. Remember, had Isaac not returned to Massachusetts to sell some of his father’s land he would also not be considered a son of Elizabeth.

In this scenario, Mary would have been the first child, Isaac the only son, and Patience the last child. I think it is pretty far fetched to conclude that Elizabeth only had one child given her history in thecourt. If Francis Walker of Woodbridge is not her father, and it would seem he is not, the only possible Walker family left is Francis Walker of Middleboro.

After I put this page up I received the land records I had ordered from the NJ archives. I expected them to verify the O mark for Francis Walker. What I did not expect was the 1714 mark to have an X mark like the 1686 Land Record. The wording of the 1714 document is such that one would draw the conclusion that Francis is settling his affairs and doesn’t really expect to be alive much longer. It has the tone of a last will and Testament. This proves that there was two Francis Walkers in Woodbridge and both must have had a wife Ann from the Woodbridge town records. If Francis and Ann only had two children, Francis and Martha then the other three must belong to Francis and Ann that used the Omark. I have been told several times that a person did not change their mark they used it for life.

The fact that there is two Walkers explains why Francis of Middleborowas not found as it was assumed that there was only ONE Francis Walker and all records pertained to him. The 1714 deed was either overlooked, accidentally, or intentionally. Possibly because it did not fit the picture that was being portrayed. Everybody took it as fact that Francis Walker was dead as explained by Robert Anderson and even though the argument was weak and based on assumptions it was accepted. For this reason I can only speculate that since the 1680 Staten Island deed and the 1706 Woodbridge deed matched and were an O mark and since Francis Walker was dead then it stood to reason there was no reason to look any further.

This case of the Walkers and the missing parents only goes to show that something written by someone with an impeccable reputation and all the credentials in the world must still be open to challenges however ridiculous somebody thinks they might be. The fact that I was ridiculed and called names only strengthened my resolve to solve this mysterythat I was told was unsolvable, but a lessor person may have caved inand called it quits and we would never have known in our lifetime thereal truth to the mystery of who were Mary and Patience Walker. That’s what made this problem so frustrating. No body wanted to question the work of some one that they held in such high esteem and let it get in the way of the facts that were out there.

I challenge all of you to go back and read the Mayflower Quarterly article from the MFQ Vol 50 NO 1 dated FEB 1984 with an open mind and see if you do not agree it is based on twisting of the facts and assumptions.

Thank you very much for your photocopies of the deeds signed by Francis Walker of NJ. Some of this material is covered by MQ 50(1 ):31-40.

It is clear from the deeds you sent that there are two men: Frances Walker, originally of Staten Island and later of Woodbridge NJ, and Francis Walker, of Middleboro MA. One major arguement for the existence of two distinct men of similar name is that in no instance is there a mention of a Francis Walker Jr. in NJ until 1719/20.

I note that Frances and Ann Walker had children recorded in Woodbridge NJ, including a son Francis Walker, b. 1693. For the 1719/20 deed, this son Francis would have achieved the age of majority, being about 27 years old.

Based on the naming of the children and grandchildren, I

propose that the family of the NJ Frances Walker looks like this:

Frances WALKER, b. ca 1640 since he was apparently a grantee in PA for 1667. He was probably m1. ca 1663 [Mary? Patience?] and probably m2. ca 1675 [Martha?] and probably m3. ca 1682/3 Ann (Wells) Freeman, widow of [Jonathan?] Freeman, and mother of Henry Freeman. This FrancesWalker d. NJ? after 5 March 1714/15 (deed).

The photocopies of the deeds you sent me just confirm that there weretwo forms of signature, and thus two men: Frances '0' Walker and Francis 'X' Walker. When Frances '0' Walker aged, or perhaps because the recording scribe standardized the format, the signature, which was given by the copier as Frances '0' Walker in the 1706 deed, was given as Frances 'X' Walker in the 1714/15 deed. The spelling of Frances with 'es' still remains the same in the 1714/15 deed.

The naming of the grandchildren of Frances Walker gives us some clues. The children of the oldest daughter, Mary (Walker)

Ayers, are interesting for the heavy reliance on familial first names:

The two grandsons named Benjamin tie together this clan as they are grandsons through Patience, daughter by the proposed

second marriage, and Francis, son by the proposed third marriage.

Also note that the names of the granddaughters of Ann (Wells) (Freeman) Walker include both Ann and Mary, thus helping to confirm the thirdmarriage of Frances Walker to Ann, and the first marriage of Frances Walker to the mother of his oldest daughter, Mary (Walker) Ayers.

Patience Walker was named as 'servant' in the will of Jeffry MANNING,1692 NJ, when Patience was about 14 years old. It is possible Patience's mother was a Manning or an Andrews (Jeffry Manning m. Hebsibah Andrews).

I would like to point out that this conundrum of the parentage of Mary and Patience Walker has been reviewed by Robert Charles Anderson in1984 [MF 50(1 ):31-40].

I have spent at least two complete days in research and

analysis on this conundrum. I have provided you with a plausible parentage of Mary and Patience Walker and would appreciate your updating your website [http:/ /kneiling.homestead.com] with the information in this letter. The website at present has numerous

small errors in the form of typos (including 'father' for 'husband', for example). I was a proofreader in an earlier career, and am brandedfor life as a result!!

About 1905 Charles H. Ayers put out a booklet I! Ancestors of Silas Ayers and Mary Byram Ayers including the Alden, Ayers and Byram Familiesl!. Nowhere in that booklet is mentioned a link to George Soule. Instead lineages back to Francis Cook, John Alden and Priscilla Mullins are put forth. This booklet and these purported lineages have been updated by Robert S. Wakefield in 1983 [TAG

59(1 ):28-31] and Barbara Lambert Merrick in 1983 [MQ 49(3): 130- 134].

The TAG article comments that former President William H. Taft joinedthe Mayflower Society on the basis of descent from Sarah (Mitchell) Hayward [MQ 44: 14] but that his descent from Francis Cooke is unproven.

There has been a lot of controversy over the proposed

Mayflower lineages in the Ayer family. Let us put to rest the

current controversy about Elizabeth Soule's proposed descendants.

If you can figure out who is descended in the various lines from the seven proposed children of Frances Walker, the modern mDNA test may beof help towards proof of descendancy from Frances Walker.

This is another reply from Louise Throop dated 6 March 2005. I have added my comments to it pointing out where I think she is wrong. I still have seen nothing to alter my position that Mary, Patience, and Isaac are children of Elizabeth Soule. I still see no other conclusion that can be drawn from this set of facts.

In a message dated 3/6/2005 3:38:43 PM Pacific Standard Time, LWTHROOP writes:

For your ancestor Mary Walker, wife of John Ayers, to be descended from George Soule one of the following improbablities would have had to occurr:

1. She would have had to be the illegitimate child of Elizabeth Soule by her premarital experience with Nathaniel Church.
As a result of this "fornication", any resulting child would have been born ca 1663 as Elizabeth Soule and Nathaniel Church were fined on3 Mar 1662/3.
As a result of this "fornication", any resulting child would have hada surname of either Soule or Church (not the Walker of the m. recordto John Ayers in 1689/90.

A more likely occurrence would be that she was born out of the 1667 Fornication charge and thus born 1667/8. That would make John Ayers 5 years older than Mary. Isaac would be the second child of Francis and Elizabeth and the first legitimate child and most likely born ca 1672,or 5 years after Mary. It is not likely that Isaac married at age 25 as he had no place to live and waited almost a full year to make a land purchase after he married. He probably had to wait until he reachedhis 21st birthday to make a land purchase. A man at age 25 and getting married surely would have had a place of his own to take a new wife.

2. She would have been married under the surname Church or Soule. Illegitimate children without family support took longer to marry, so I estimate a marriage date for this fornication child at about 1685. Women tended to marry a man a couple of years older, say born about 1659, unless they married as the man's second wife, when the woman tendedto be about 10 or more years younger. Thus a proposed husband would be born either about 1659 or about 1649. Your John Ayers does not fitthis profile as he was born 1663 in Newbury.

If Mary B ca 1667/8 John is 5 years older than Mary, and she bore children for 20 years of her marriage to John

3. If she is the result of the marriage of Elizabeth Soule to FrancisWalker ca 1667/8, then she would be born after son Isaac, say ca 1670....
As a result of this birth order, she would have been married as 'MaryWalker'.
But Mary is a rather common name, so let's try the following:

I think the facts show that Mary is older not younger than Isaac. Mary marries in 1688 and Isaac in 1692, and makes his land purchase a year after that

FRANCIS WALKER OF NJ
Francis Walker pops up in NY/NJ as early as about 1667, when a surveyof a patent at Point Pleasant on the West side of the Delaware River is made for Frances Walker and Dunk Williams.

Next Francis Waker/Walker shows up in a 1671 census of Passaymunt/Passayunck NJ, along with Frederick Andrews.

Remember: the Durch secured New York and all its dependencies including NJ in 1673.

But Francis Walker stays on his land: Francis Walker and Dunck Williams have jury duty together 11 July 1676.

This Francis also has a tendency to move around, he is on the Delaware, Passaymunt, Staten Island, Woodbridge. He sold his land in Woodbridge in 1706 where did he go from there? The other Frances Walker is still there until sometime after 1714

This Francis Walker apparently m. ca 1682/3 Ann (Wells) FREEMAN, whose son Henry Freeman was apparently b. ca 1680 or before.

NOTE: it is this Henry Freeman, a step-brother to Patience Walker, for whom Patience (Walker) Drake named her 6th son Henry Drake. This naming pattern with the unique name Henry, ties Patience to Francis Walker of NJ.

There is NO DOUBT in my mind that Patience is a daughter of the Francis Walker of NJ who also had children by Ann recorded in Woodbridge NJ. Patience, however, is by a prior wife of Francis Walker.

Patience Walker is mentioned in the will of Jeffry MANNING in 1692 inNJ, when Patience was about 14 years old. It is possible Patience'smother was a MANNING or an ANDREWS, as Jeffry Manning m. Hepsibah ANDREWS. Thus the Frederick ANDREWS of the 1671 census suddenly becomes important to the story line. Have you investigated the Andrews family???

BACK to Mary Walker: if she is b. ca 1670, as she married 1689/90 toJohn AYERS in NJ, then perhaps she was b. in NJ. The likely father is Francis Walker of the 1671 census of Passayunck NJ.

The alternative father, Francis Walker of Middleboro MA, has no records in NJ and several records in Middleboro. His son Isaac Walker shows up in Woodbridge NJ for his 8 July 1692 marriage to Desire SHELLEY. Unless you can prove that John Ayers met Mary Walker in MA and then married her in NJ in 1689/90, the family pattern is totally WRONG:a brother would go out and marry first, his sister would come to visit and then find a husband from among her brother's approved friends AFTER her brother's marriage.

There is no record for Francis Walker after 1686 in Middleboro. in 1688 Mary gets married in NJ, in 1692 Isaac gets married in NJ (first known reference to Isaac.), in 1692 Patience mentioned in Jeffery Manning will, in 1697 John Hascall acts in behalf of Francis Walker for some reason not stated, what ever the reason he was not there, or not able.

There is most definately two Francis in NJ and the different spellingFrances/Francis can not be considered definitive proof that it is notthe same Francis Walker as Middleboro. Remember neither man could read or write and it was up to the writer of the document to decide how it should be spelled and this Frances Walker used the same mark as theMiddleboro Francis. Various transcriptions of Woodbridge records alsoreflect this as Frances is transcribed Francis on more than one occasion.

Isaac Walker bought and sold land briefly in Woodbridge NJ, apparently returning ca 1701/2 to settle his father's estate. He probably returned again to NJafter 1702.

That he returns to settle his fathers estate is a total fabrication and not justified by the facts.. The transaction as transcribed clearlyshows that Francis is alive! The John Hascall transaction of 1709 clearly shows that Francis must still be alive at that time!! The possibility of two Francis Walkers using the same mark is not very good, Not very common for two people with the same name to use the same mark. U fortunately for us he chose to use a simple X when most marks were a little more elaborate

Woodbridge NJ was settled by many from MA, so the arrival of Isaac Walker for his marriage in 1692 is not out of the ordinary.

What would be out of the ordinary is if he is only 20 years of age atthe time he married and may have come to NJ as early as 1686/8 makinghim only 14 to 16 if he arrived with Francis Walker of Middleboro. Also the fact that Patience first shows up in 1692 could also be considered out of the ordinary as she has no ties to anyone that are apparentat first look.

Where is this deed, it is not in the NJ State Archives. I have not seen it and according to Bette Epstein I have all of them on record. Samuel is a brother to John Ayers. Also Francis Jr is the son of Francis X Walker not the O Walker as shown in the 1714/1720 deed to his children.

If it exist and if indeed it is signed Francis O Walker then there issome serious issues with the original records and nothing in them canbe relied on as factual. Name spellings were at the whim of who wrotethe document. One only has to look at the census records to see that, but a mans mark was his unique identity and did not change and if it were allowed for a transcriber to change that mark then all credibility in the records would have been lost.

I'd like to correspond with someone who has verifiable data on the parents of the John West who married Amey Wilcox December 29, 1765 at Westerly, RI. Wheeler's book The History of Stonington, Connecticut saysJohn's parents are Thomas West and Elizabeth Dungan. The Dungan groupsays Elizabeth Dungan married Nathaniel West and never had a son John. The LDS Ancestral File shows TWO SETS of parents for John West, John West and Alice Sweet, and Francis West and Mary. Any clarification will be appreciated.
